Website Terms

Clear boundaries before work begins.

Effective: July 22, 2026

These Website Terms (“Terms”) govern your use of this website and inquiry route provided by Nashville Business Works, operated by Trey Hamm (“NBW,” “we,” “us,” or “our”).

1. Business use and acceptance

By using this site, you agree to these Terms and the Privacy Policy. You must be at least 18 and have authority to act for yourself or the business or organization you identify. If you do not agree, do not use the site or submit an inquiry.

2. An inquiry is not an engagement

Submitting an inquiry, receiving an automated receipt, discussing a project, or receiving general information does not create a client, fiduciary, employment, partnership, or agency relationship. NBW may accept or decline an inquiry.

Work begins only after the parties approve a written quote, scope, or client agreement that identifies the work, inputs, exclusions, timing, price, payment terms, and other engagement-specific conditions. If a signed client agreement conflicts with these Website Terms, the client agreement controls for that engagement.

3. Service information and outcomes

Website descriptions are general information, not a standing offer or guarantee. Availability, fit, scope, methods, timing, and price depend on the specific request. “Urgent” is triage context, not a promised response or turnaround time. NBW does not promise a particular revenue, ranking, lead volume, conversion, cost saving, or other business outcome unless a written client agreement expressly says otherwise.

4. Your submissions

You represent that you have the right and authority to provide any inquiry text and links you submit. You keep ownership of your materials. You grant NBW a limited permission to receive, copy, review, and use them only as reasonably needed to evaluate the inquiry, communicate with you, protect the service, and perform approved work under a later agreement.

Do not submit unlawful material; malware; deceptive or abusive content; third-party confidential material you lack authority to share; passwords; credentials; payment-card data; regulated records; or other sensitive information. The public intake route does not accept file uploads.

5. Acceptable use

You may not interfere with the site, bypass security or rate limits, probe for vulnerabilities without written permission, impersonate another person, scrape at abusive volume, use the service to violate law or third-party rights, or submit spam. We may restrict access or discard abusive inquiries.

6. Site content and intellectual property

The site’s branding, original text, graphics, layout, and software are owned by NBW or used with permission and are protected by applicable law. You may view and make ordinary business-use references to the site, but you may not copy, sell, republish, misrepresent, or create a confusingly similar service from protected site materials without permission.

7. Third-party services and links

The site depends on third-party hosting, security, email, and inbox providers and may link to other sites. NBW does not control third-party sites and is not responsible for their independent content, availability, or practices. Your use of them may be governed by their terms.

8. Website availability and disclaimer

The website and its general information are provided on an “as available” basis. To the fullest extent permitted by law, NBW disclaims warranties about uninterrupted availability, error-free operation, completeness, merchantability, fitness for a particular purpose, and non-infringement. This paragraph applies to the public website and does not replace express commitments in a signed client agreement.

9. Limitation of liability

To the fullest extent permitted by law, NBW will not be liable under these Website Terms for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from use of—or inability to use—the public website. NBW’s total liability arising solely from the public website will not exceed $100. Limits for paid client work belong in the applicable client agreement. Some jurisdictions do not allow every exclusion, so these limits apply only to the extent permitted.

10. Tennessee law and disputes

These Website Terms are governed by Tennessee law, without regard to conflict-of-law rules. Any dispute arising solely from the public website or these Terms must be brought in a state or federal court with jurisdiction in Davidson County, Tennessee, and each party consents to that venue, except where applicable law requires otherwise.

11. Changes, severability, and contact

We may update these Terms as the website or operating model changes. The effective date above identifies the current version. If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.
